Staywatt

Terms and conditions

This is a draft version. The terms will be established and legally reviewed before the start of the paid service.

1. Who are we?

Staywatt is a service of Point2Create BV, KvK 63324547. These terms apply to the use of the website, the purchase of the equipment and the service provided with it.

2. What we provide — and what we don't

We supply a metering module for your meter box and a service that measures consumption, keeps track of your guest's credit and settles accounts based on it. We are not an energy supplier. The electricity that your guest consumes you purchase from your own supplier; what you charge him for it is up to you.

We do not assess your meter box, your rental agreement or your supply contract, and we give no guarantee that in your case you are allowed to pass on energy costs or in what manner. This is not caution but a fact: it depends on your contract and your situation, and we do not know those.

3. The module

You purchase the module; it becomes your property as soon as it is paid for. We set it up and connect it to your object before it leaves our premises. If you cancel the service later, you keep the box — it will no longer work with our system.

The module is designed to be installed yourself following the drawing in the box, and it is work of approximately one hour for someone who understands meter boxes. The installation is your responsibility, even if you carry it out yourself. We recommend having it done by a certified installer.

The module is covered by statutory warranty. If it fails within that period without anything happening to it, we will replace it; we keep spare modules in stock so that can happen within a few working days.

4. Your guest's credit

A guest purchases kilowatt-hours in advance. That money is intended for the electricity he consumes from you: we process the payment and keep track of the credit, and settle it with you according to the chosen model.

If credit remains at the end of a stay, you decide what happens to it — refund or let it lapse — and you must make that clear to your guest before the purchase. We display that choice in the app; the agreement itself is between you and your guest.

5. What happens when credit runs out

When credit is empty, the module switches off the circuits you have designated for that purpose. This is the agreed operation and not a malfunction. The circuit for refrigerator, router and central heating remains always on.

We are not liable for consequences of a disconnection that takes place according to that agreement. However, we are answerable if disconnection occurs while there was credit, or if the always-on circuit fails: that should not be possible and we will resolve it.

6. If the connection is lost

The module counts down locally on the credit it had, even without connection to us. Your guest will not notice and the settlement remains correct. What cannot happen during that time is topping up: a purchase reaches the module only once it has connection again.

We endeavor to keep the service available, but give no guarantee of uninterrupted availability — internet, network management and the electricity itself are beyond our control.

7. Subscription and payment

The subscription runs per property, per month or per year, and is cancellable at the end of the term. All prices are exclusive of VAT. For business customers outside the Netherlands with a valid VAT identification number, VAT is reversed.

If you cancel, your invoices and your consumption statements remain available for as long as the law requires, so you can still substantiate a settlement with a guest.

8. Liability

We are not liable for indirect damage or for circumstances beyond our reasonable control. Our liability is limited to the amount you have paid to us in the twelve months before the incident.

Nothing in these terms limits liability that cannot be excluded under mandatory law, including liability for intent or gross negligence.

9. Applicable law

Dutch law applies to these terms and conditions. If you have a complaint, please let us know first via office@staywatt.eu; if we cannot resolve it together, you may turn to the competent Dutch court.
